WHAT WE ARE OFFERING

Please read this page carefully before purchasing your gift voucher. These terms and conditions form the basis of a contract between us (Bright Red Box Ltd), and you (the purchaser, any subsequent holder of the gift voucher and/or the redeemer of a gift voucher), once we have processed your order and received payment. Whilst every effort is made to ensure the descriptions and pictures contained within the website and on gift vouchers are a true reflection of the events in respect of which the voucher may be redeemed, these do not form part of a contract. All Bright Red Box Ltd Gift Vouchers (“Vouchers”) carry a unique pin number which must be quoted when dealing with Bright Red Box Ltd and its operators. All unique pin number must be kept safely and securely and should be taken on the day of the experience and surrendered to the operator or alternatively sent to the operator if requested to secure the booking. We cannot accept responsibility for any loss you may incur as a result of theft, impersonation or identity fraud. Placing an order means you accept the terms of Bright Red Box Ltd.


ORDERS AND PRICING

We reserve the right to change prices without notice, provided we inform you before the voucher experience is redeemed or booked. Vouchers will not be issued until payment is collected in full. All prices shown on Bright Red Box Ltd websites are in GBP and all transactions are conducted in GBP. If ordering from overseas or from a foreign currency account, you may be charged fees by your bank to process the transaction. These fees are in addition to any prices on our website and are beyond our control. The prices of specific experiences against which gift vouchers can be redeemed which are displayed on our website are correct to the best of our knowledge and maintained on a daily basis. In the event of a voucher being issued at or redeemed against an accidental incorrect price, we will endeavour to inform the purchaser of the error within seven days of the voucher purchase / voucher redemption being made, we will allow the recipient to either obtain a full refund against the voucher or choose to pay the additional difference in price. Promotional discount codes can only be redeemed against certain Bright Red Box Ltd vouchers. If an order cannot be fulfilled for any reason, Bright Red Box Ltd will promptly refund all monies. Duplicate orders are sometimes inadvertently placed or dispatched. We ask that you return any duplicates immediately or contact us for further instructions. If both vouchers are used, we will be entitled to claim payment for the costs incurred.

STAYING SAFE - SECURITY

All payment processing is carried out entirely on our behalf by PayPal, the trusted leader in online payments: Bright Red Box Ltd does not see or have access to your financial information at any time. Once your payment is complete, you will be emailed a receipt for this transaction. Your confidential information will be processed by PayPal, automatically from your digital device (computer, mobile etc.) to PayPal. Bright Red Box Ltd will not be liable for any loss or damage, financial or otherwise as a result of you using PayPal’s payment gateway.


TO USE YOUR GIFT VOUCHER

Customers must be of the countries lawful age or over to buy and/or use gift vouchers containing alcohol, driving or any such activity that is restricted by age on Bright Red Box Ltd and must provide proof of age if requested. By completing the order, you are confirming you are of the lawful age or whom so ever you are gifting or redeeming the gift voucher is of lawful age to patriciate with the operator’s experience and/or activities. On delivery, you may be requested to show proof of identification (with a photograph) to verify the age of the person accepting delivery. If acceptable identification cannot be provided the goods or services will be returned to the operator, but you may still be charged or incur additional costs. You are to get the face value of the voucher experience unless otherwise indicated on the website or voucher. Voucher and gift cards have no cash value and have to be redeemed against experiences offer at or above price by the operators.

Each gift voucher is valid for a maximum of 9 (nine) months from the date of issue unless otherwise stated. The exact expiry date will be printed on the voucher or advised upon successful purchase or redemption activation. Vouchers can only be extended if they are still inside their expiry date and if the experience is still available from the operator. If the activity in respect of which the voucher is to be redeemed has increased in price, the customer will also need to pay the difference in price. A Voucher can only be extended once and must be done while the voucher is valid. A £20 administration fee is payable if you choose to extend your validity. Extended or exchanged vouchers cannot be refunded. Delays, curtailments and breakdowns are not within Bright Red Box Ltd’s control, we cannot be held liable if these should occur. Please note that we reserve the right to alter any part of the experience where such an alteration has been imposed by the operator.


WHEN BOOKING

To arrange a time and place for your experience you are asked to choose your preferred location from Bright Red Box Ltd’s Map then follow the Initial Booking Instructions. Bright Red Box Ltd has no responsibility or liability to you for payments made by any other means directly to our operators. If you pay your operator directly by any method, you should obtain a receipt and follow their terms and conditions. Bright Red Box Ltd accepts no responsibility for any payments made directly to instructors or organisers of events, activities or experiences.

Keep a record of your unique pin number. You may also be required to pay a deposit to the provider to confirm your booking in advance. This deposit will be credited back upon completion of your experience. Please note you may not be able to change your mind once a date has been booked with an operator.

Please do not arrive at a venue expecting to redeem your gift voucher without first obtaining a booking confirmation letter or number from the operator. Bright Red Box Ltd will not be held liable for your costs incurred if you do not follow the procedure set out in operator’s terms and conditions or Bright Red Box Ltd's terms and conditions in your voucher pack.


EXPECTING YOUR DELIVERY

As soon as you place your order your personalised voucher gift pack sent in our signature bright red box, in plain outer packaging will be sent to you (or the recipient) containing the gift vouchers (valid for 9 months from date of purchase), booking instructions and information booklet.

Delivery

Standard delivery and packaging is charged at £4.95 Royal Mail, usual delivery time is 1 - 5 working days.

All Bright Red Box Ltd gift packs are dispatched under plain cover, on the day you order if we receive your order before 2pm within the UK. Please remember to allow extra time for deliveries around special occasions such as Christmas, Valentine’s Day, Mother’s and Father’s Day. Bright Red Box Ltd cannot be held responsible for any goods damaged in the post or any postal delays.


REFUNDS

Refunds can be made on unused vouchers bought direct from Bright Red Box Ltd within 14 days of purchase. Refunds can only be made to the purchaser and the monies will be refunded directly to the original method of payment. The following tangible gifts cannot be refunded: personalised items, perishable goods or earrings (for hygiene reasons). Bright Red Box Ltd reserves the rights to deducted the expenses of these items from the refund. A voucher purchased through a retailer or other reseller will be subject to that retailer’s own refund policy and enquiries must be made directly to them. We cannot refund items purchased from a retailer or other resellers. To request a refund please send your voucher along with a covering letter explaining the reason for your request to Bright Red Box Ltd.


CANCELLATIONS

Once you have confirmed your booking date with a venue you are bound by their terms and conditions regarding cancellations or changes. It is not possible to change the booking unless the venue agrees to the change.

Sometimes the venue may need to cancel the experience at short notice for reasons beyond their control, such as adverse weather conditions, illness or mechanical breakdowns. Therefore, we strongly recommend that you contact the venue on the day before you depart for your experience to check. We regret that in the event of cancellation, Bright Red Box Ltd is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled experience. Please note, that the activities may require waiting times, especially as some are weather dependant. There is also the possibility of short notice cancellation by an activity operator due to weather, mechanical problems, staff illness or other unforeseen circumstances beyond the operator’s control. In the event that an activity is cancelled you should simply re-book with the activity operator concerned.

In case of a problem, please speak to the experience operator on the day, so they have the opportunity to resolve any problems there and then. Any other complaints should be addressed with the customer service department at Bright Red Box Ltd.

Once you make a booking with an experience operator you are bound by their terms and conditions. Make sure you understand their rules regarding changing or cancelling a booking (particularly at short notice) as a refund will not be offered in the case of infringement of these rules.

You may cancel a redemption or booking in the following circumstances by notification to Bright Red Box Ltd and the operator, and in such cases will be liable to pay the following cancellation charges:

  • Without an existing booking, with no charge;
  • With an existing booking, more than 72 hours before the start of the activity or experience, with a charge of 50% of the gift voucher face value, at the operator’s discretion (subject to a maximum of £50) plus a Cancellation Administration Charge;
  • With an existing booking, between 72 hours and 24 hours before the start of the activity or experience, with a charge of 60% of the of the gift voucher face value, at the operator’s discretion (subject to a maximum of £50) plus a Cancellation Administration Charge;
  • With an existing booking, less than 24 hours before the start of the activity or experience, with a charge of 100% of the of the gift voucher face value, at the operator’s discretion (subject to a maximum of £100) plus a Cancellation Administration Charge.


You may cancel a redemption or booking by notification to Bright Red Box Ltd and the operator where, following the inspection of the premises or vehicle at the start of the activity or experience, the operator is not roadworthy in accordance with this terms. In such cases, the operator will be deemed to have cancelled the redemption and booking and the terms shall apply.


LIABILITY COVER

All UK and Eire experience operators contract with us to indemnify participating gift voucher holders against damage to equipment they use, and against liabilities to third parties, subject to limits and compliance with their rules, terms and conditions, which may vary between operators. We also hold cover, subject to terms and limits, for contingent liabilities arising at these operators’ venues. Where experiences require overseas travel, the participant is strongly advised to take out additional specialist travel insurance. Some experience operators may offer additional indemnities at an extra cost. Such indemnities are entirely optional and you are under no obligation to purchase them, as your entitlement to undertake the experience will not be affected if you choose not to accept an additional indemnity. Any additional indemnities purchased from an experience operator will be governed by that operator’s terms and conditions and do not form any part of your contract with Bright Red Box Ltd.


WEBSITE WARRANTIES

Bright Red Box Ltd does not guarantee the timeliness, completeness or performance of the website or any of the content. While we try to ensure that all content featured on the website is correct at the time of publication, no responsibility is accepted by Bright Red Box Ltd for any errors, omissions or inaccurate content on the website.

We will not be liable for any loss or damage, financial or otherwise as a result of you using the information provided on the website, nor does Bright Red Box Ltd guarantee the suitability or quality of any products or services featured on the website.

Bright Red Box Ltd does not warrant that access to the website or the features on the website will be uninterrupted or error free. Nor does Bright Red Box Ltd warrant that the server on which the website is based is free of viruses or other harmful code.


THIRD PARTIES AND RE-SALE

A person who is not named on the face of the voucher or recorded as the purchaser by Bright Red Box Ltd has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms and conditions of redeeming. A Voucher which has been re-sold (for example, through Internet auction sites or by any other means) without our prior consent will be considered invalid. Neither Bright Red Box Ltd nor any of its experience operators will be under any obligation to provide any service. Please note that we have the ability to retain any data that you provide on this website, even if you do not complete your registration/transaction by clicking submit/next. Such contact details and data may be used to contact you to enquire why you did not complete your registration/transaction and improve our online operations.


INTELLECTUAL PROPERTY

You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use Bright Red Box Ltd content in any way except for your own personal use. Nor may you use the website to create, amend, update or verify any databases, directories, customer lists, mailing lists or other records.

The use of Bright Red Box Ltd data as a source or target for direct marketing, telemarketing, market research, or any other marketing activity on yours, or someone else's behalf, is strictly prohibited.

The content of the website, including but not limited to text, graphics, logos, software and trademarks are the property of Bright Red Box Ltd and are protected by copyright and other laws. BRIGHT RED BOX LTD does not tolerate copyright infringement and will actively pursue any known infringement to the full extent of the law.


USER ACCOUNTS

We reserve the right to send you certain communications relating to your account, such as service announcements and administrative messages without offering you the opportunity to opt-out of receiving them. Any marketing emails and newsletters we send will only be sent to you with your permission and will detail how to unsubscribe from these mailings should you wish in future. You may not use, or allow others to use, your account to:

  • Post any content that is abusive or defamatory or which discloses private or personal matters concerning any person.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with anyone or entity.


GENERAL

Bright Red Box Ltd may change, alter or modify these terms at any time. Any changes to these terms will be posted on the website. If you do not agree to terms on this page, you should cease use of the website.

These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser and Bright Red Box Ltd agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.

The funds on vouchers are not covered by the Finical Services Compensation Scheme. In the unlikely event of the issuer of this product becoming insolvent, some funds on vouchers may not be available to spend.
